PEN Belarus approaches program participants, donors, partners, co-owners, employees, newsletter subscribers, visitors to its website, and those who entrust us with the processing of personal data with reverence.
Who processes the personal data?

which is the controller of such data within the meaning of Regulation 2016/679 of the European Parliament and of the Council of the European Union of April 27, 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and the repeal of Directive 95/46/EU and Polish legislation.
PEN Belarus receives only personal data that are provided voluntarily and are needed for specific purposes. Personal data are securely stored and protected from loss, destruction, misuse, and unauthorized access.
1.Purpose and time of holding personal data
When you send us an application for participation in events, programs, or awards (hereinafter: programs) PEN Belarus may obtain information about your citizenship, full name, gender, date of birth, e-mail address, instant messaging, telephone number, place of residence, information about education (including informal), level of foreign language proficiency, place of study/work, place of previous work, membership in NGOs, participation in educational activities, cooperation with NGOs; information about publications and references to them; special needs, as well as other personal data provided by the programs. In the case of participation in a literary award, information about books, bibliographic data of the author, their biography, and other information necessary for the granting of the literary award.
We use this information to enable participation in our programs and to invite you to participate in future programs; to offer information on future events and programs; to select participants in case of participation in a competition. If you participate in a program on a competitive basis, your personal information is transferred, including to an expert committee. Depending on the grant agreement, personal data may be made available to donors for review.
The program participant’s data will be kept for the duration of the program, including subsequent activities (e.g., writing a report), extended by additional time required under the terms of the grant agreement and the laws of the Republic of Poland;
2.When PEN Belarus signs a contract with a contractor– an individual, the following personal data are collected: name, surname, registered address, date of birth, passport or PESEL number, bank account number, and mandatory tax and insurance data.
PEN Belarus uses the information to pay salaries and fulfill other obligations under the contract.
The contractor’s data will be kept for the duration of the contract or agreement plus a period of 10 years unless otherwise provided by the laws of the Republic of Poland.
3.If you apply for a job at PEN Belarus, PEN Belarus asks you to send a resume (name, surname, e-mail address, and additional specified information).
PEN Belarus uses the information to review job applications or make relevant job offers.
The data will be kept for the period of the applicants’ consideration and then for another two years.
4.When you sign up for the newsletter, PEN Belarus receives your name and email address.
We use the data to send recommended information.
The information is stored until you unsubscribe from the newsletter.
5.When one becomes a member of PEN Belarus, the following data are collected: the name of the legal entity/the name of the natural person, NIP, KRS numbers of the legal person/PESEL or ID card number of the natural person, the address of seat/place of residence, curriculum vitae, a list of publications, books, a list of awards, competitions, projects in which they have participated, and other information provided by Polish legislation or the application form.
We use this information to register a member in the PEN system and send relevant information about our activities.
The data is kept for the period of PEN membership and 5 years after the termination of membership.
6.While you are using our website, we collect technical information (cookies).
When you use the PEN service, small files (especially text files) are stored on your terminal device (computer, tablet, smartphone, etc.), which contain information necessary for the use of the PEN service, the so-called cookies. Cookies make it possible to collect statistical data for the PEN website, which allows to develop the business activities of PEN Belarus. Cookies do not contain personal data, are not harmful in any way to your device, and do not change its settings, or the settings of the software installed on it.
The right to control your personal information
PEN Belarus guarantees that any person who provides personal information to PEN Belarus has the right to request and receive a copy of all information that PEN Belarus has about the person, and to request correction of inaccurate or outdated information.
If PEN Belarus wishes to use personal information provided to PEN Belarus for a new purpose other than the one for which the information had been originally provided, or for purposes not provided for in this Privacy Policy, PEN Belarus shall make a specific request to individuals for permission to use the personal information, as well as explain the manner and purpose of their use.
You have the right to withdraw consent to the processing and storage of your data by PEN Belarus at any time.
Conditions under which PEN Belarus transfers personal data to third parties
PEN Belarus confidentially processes personal data and transfers them to other individuals and organizations only with the consent of the person when it is necessary to provide the declared services or those to which the person has consented. In all other cases, PEN Belarus does not transfer personal data to third parties without the express consent of the data subject, except when required by the legislation of the Republic of Poland.
Data Retention Policy
PEN Belarus strives to ensure that only the data necessary for the effective implementation of its programs, projects, and strategic goals are retained.
PEN Belarus protects the security of personal data by utilizing appropriate technical and organizational measures aimed at preventing illegal data processing and accidental data loss, destruction, and damage.
We do our utmost to ensure that your data is always:
– processed in compliance with the law,
– obtained only for the designated purposes and not further processed in a manner incompatible with those purposes,
– kept no longer than necessary,
– processed following the rights of data subjects, including the right to object to sharing,
– transferred only with adequate security.
To increase the security of your data, we recommend the following:
– using anti-virus software, including regular disk scans for viruses;
– transferring personal data through trusted computers on which only verified and legal software is installed. Using other people’s computers poses the risk of personal information being intercepted;
– not storing information on a computer/device and deleting browsing history/deleting correspondence/logging out of an instant messaging account on someone else’s device. Stored data can be used by someone after you use the same device.
PEN Belarus makes every effort to avoid duplicating the personal data it stores but acknowledges that in some cases, due to software or other reasons, data may be stored in several places.
Scope of the Regulations
These Regulations apply to all data received and stored by PEN Belarus, regardless of where it is stored. The Regulations apply to information collected both in digital and analog form (including photographs, video, and sound recordings), as well as information stored in paper form. Data storage is subject to Polish law, RODO, and relevant international regulations.
Data Destruction Policy
PEN Belarus guarantees that it fully controls the personal data it collects and processes. After the expiration of the retention period as stated above, PEN Belarus will destroy the data described in the Regulations.
If a PEN Belarus employee or team member believes that there is a legitimate reason why certain data should not be destroyed after the end of the retention period, they must identify the specific data and inform management why the data should not be destroyed. Any exceptions to the Data Retention Policy must be agreed upon with an authorized person of the PEN Belarus.
Only individuals with authorization granted by the data controller have access to their personal data.

Białoruski PEN otrzymuje tylko te dane osobowe, które zostają podane dobrowolnie i są potrzebne do określonych celów. Dane osobowe są bezpiecznie przechowywane i chronione przed utratą, zniszczeniem, niewłaściwym wykorzystaniem i nieautoryzowanym dostępem.
W jakim celu przetwarzane są dane osobowe i przez jaki okres są przechowywane
1.Gdy dana osoba wysyła zgłoszenie udziału w wydarzeniach, programach, nagrodach (dalej – programach) Białoruski PEN może uzyskać informacje o obywatelstwie, pełnym imieniu, płci, dacie urodzenia, adresie e-mail, komunikatorach, numerze telefonu, miejscu zamieszkania, informacje o wykształceniu (w tym nieformalnym), poziomie znajomości języka obcego, miejscu nauki/pracy, miejscu wcześniejszej pracy, przynależności do organizacji pozarządowych, uczestnictwie w zajęciach edukacyjnych, o współpracy z organizacjami pozarządowymi; o publikacjach i odniesieniach do nich; specjalnych potrzebach, innych danych osobowych dostarczanych przez programy. W przypadku udziału w nagrodzie literackiej zbierane są informacje o książkach, dane bibliograficzne ich autora, jego życiorys oraz inne informacje niezbędne do przyznania nagrody literackiej.
Używamy tych informacji, aby osobiście umożliwić Państwu udział w programach, aby zaprosić Państwa do udziału w kolejnych programach; oferować informacje dotyczące przyszłych wydarzeń i programów; do wyboru uczestników w przypadku udziału w konkursie. W przypadku udziału w programie na zasadach konkursowych dane osobowe są przekazywane, w tym komisji eksperckiej. W zależności od umowy o dofinansowanie dane osobowe mogą być udostępniane darczyńcom do wglądu.
Dane uczestnika programu będą przechowywane przez okres trwania programu, wliczając w to późniejsze czynności (np. napisanie raportu), poszerzone o dodatkowy czas wymagany zgodnie z warunkami umowy o dofinansowanie oraz przepisami prawa Rzeczypospolitej Polskiej;
2.W przypadku podpisania przez Białoruski PEN umowy z kontrahentem – osobą fizyczną, zbierane są następujące dane osobowe: imię, nazwisko, adres siedziby, data urodzenia, numer paszportu lub PESEL, numer rachunku bankowego, obowiązkowe dane podatkowe i ubezpieczeniowe.
Białoruski PEN wykorzystuje te informacje do wypłaty wynagrodzenia i wypełnienia innych zobowiązań wynikających z umowy.
Dane kontrahenta będą przechowywane przez okres obowiązywania umowy lub umowy plus okres 10 lat, chyba że przepisy prawa Rzeczypospolitej Polskiej stanowią inaczej.
3.W przypadku ubiegania się o pracę w Białoruskim PEN-ie, Białoruski PEN prosi o przesłanie CV (imię, nazwisko, adres e-mail oraz dodatkowe określone informacje).
Białoruski PEN wykorzystuje te informacje do przeglądania podań o pracę lub zgłaszania odpowiednich ofert pracy.
Dane będą przechowywane przez okres rozpatrywania kandydatów i potem przez kolejne dwa lata.
4.Gdy dana osoba zapisze się do newslettera, Białoruski PEN otrzymuje imię i nazwisko oraz adres e-mail.
Używamy tych danych do wysyłania polecanych informacji.
Informacje są przechowywane do momentu wypisania się z newslettera.
5.Przy przystąpieniu do Białoruskiego PEN-u zbierane są: nazwa osoby prawnej/imię i nazwisko osoby fizycznej, NIP, numery KRS osoby prawnej/PESEL lub numer dowodu osobistego osoby fizycznej, adres siedziby/miejsce zamieszkania, życiorys, wykaz publikacji, książek, wykaz nagród, konkursów, projektów, w których brali udział, inne informacje zgodne z polskim ustawodawstwem lub formularz zgłoszeniowy.
Używamy tych informacji, aby zarejestrować znajomego w systemie PEN-u i wysłać odpowiednie informacje o działalności PEN-u.
Dane są przechowywane przez okres członkostwa w PEN-ie oraz 5 lat po ustaniu członkostwa.
6.Podczas korzystania z serwisu gromadzone są pliki cookies – informacje techniczne.
Podczas korzystania z serwisu PEN na urządzeniu końcowym (komputerze, tablecie, smartfonie itp.) zapisywane są niewielkie pliki (w szczególności pliki tekstowe), które zawierają informacje niezbędne do korzystania z serwisu PEN, tzw. cookies. Pliki cookies umożliwiają gromadzenie danych statystyczne dla serwisu PEN, co pozwala rozwijać działalność Białoruskiego PEN-u. Pliki cookies nie zawierają danych osobowych. Pliki te nie są w żaden sposób szkodliwe dla Państwa urządzeń i nie zmieniają ich ustawień ani ustawień zainstalowanego na nim oprogramowania.
Prawo osoby do dysponowania danymi osobowymi
Białoruski PEN gwarantuje, że każda osoba, która przekazuje dane osobowe Białoruskiemu PEN-owi, ma prawo zażądać i otrzymać kopię wszystkich informacji, które PEN o danej osobie posiada, zażądać sprostowania niedokładnych lub nieaktualnych informacji.
Jeżeli Białoruski PEN chce wykorzystać dane osobowe przekazane Białoruskiemu PEN-owi do nowego celu, innego niż ten, w którym informacje zostały pierwotnie przekazane, lub do celów nieprzewidzianych w niniejszej Polityce prywatności, Białoruski PEN kieruje do osób fizycznych specjalną prośbę o zgodę na wykorzystanie danych osobowych wraz z wyjaśnieniem sposobu i celu ich wykorzystania.
Osoba ma prawo w dowolnym momencie wycofać zgodę na przetwarzanie i przechowywanie jej danych osobowych przez Białoruski PEN.
Warunki, na jakich Białoruski PEN przekazuje dane osobowe podmiotom trzecim
Białoruski PEN przetwarza dane osobowe w sposób poufny i przekazuje je innym osobom i organizacjom wyłącznie za zgodą osoby, gdy jest to niezbędne do świadczenia deklarowanych usług lub tych, na które osoba ta wyraziła zgodę. We wszystkich innych przypadkach Białoruski PEN nie przekazuje danych osobowych osobom trzecim bez wyraźnej zgody osoby, której dane dotyczą, z wyjątkiem przypadków, gdy jest to wymagane przez ustawodawstwo Rzeczypospolitej Polskiej.
Zasady przechowywania danych
Białoruski PEN dąży do zapewnienia zachowania tylko tych danych, które są niezbędne do skutecznej realizacji programów, projektów oraz realizacji celów strategicznych.
Białoruski PEN chroni bezpieczeństwo danych osobowych za pomocą odpowiednich środków technicznych i organizacyjnych mających na celu zapobieganie nielegalnemu przetwarzaniu danych oraz ich przypadkowej utracie, zniszczeniu i uszkodzeniu.
Dokładamy wszelkich starań, aby Państwa dane osobowe zawsze były:
– przetwarzane zgodnie z prawem,
– pozyskiwane wyłącznie dla oznaczonych celów i nie były dalej przetwarzane w sposób niezgodny z tymi celami,
– przechowywane nie dłużej niż to konieczne,
– przetwarzane zgodnie z prawami przysługującymi osobom, których dotyczą, w tym zgodnie z prawem sprzeciwu wobec wspólnego korzystania,
– przekazywane tylko przy odpowiednim zabezpieczeniu.
Aby zwiększyć bezpieczeństwo Państwa danych, muszą Państwo pamiętać o następujących kwestiach:
– korzystanie z programów antywirusowych, w tym regularne skanowanie dysku w poszukiwaniu wirusów;
– przesyłanie danych osobowych przez zaufane komputery, na których zainstalowane jest wyłącznie sprawdzone i legalne oprogramowanie. Korzystanie z cudzych komputerów stwarza ryzyko przechwycenia danych osobowych;
– nie zapamiętywać informacji na komputerze/urządzeniu i usuwać historię przeglądanych stron/usuwać korespondencję/wylogować się z konta komunikatora na czyimś urządzeniu. Zapisane dane może wykorzystać osoba, która po Państwie będzie korzystać z tego samego urządzenia.
Białoruski PEN stara się unikać powielania danych osobowych, które przechowuje, ale przyznaje, że w niektórych przypadkach, z powodu oprogramowania lub innych powodów, dane mogą być przechowywane w kilku miejscach.
Zakres Regulaminu
Niniejszy Regulamin dotyczy wszystkich danych otrzymywanych i przechowywanych przez Białoruski PEN, niezależnie od miejsca ich przechowywania. Zasady dotyczą informacji gromadzonych zarówno w formie cyfrowej, jak i analogowej (w tym fotografii, nagrań wideo i dźwiękowych), a także informacji przechowywanych w formie papierowej. Przechowywanie danych podlega prawu polskiemu, RODO oraz odpowiednim przepisom międzynarodowym.
Usuwanie danych osobowych
Białoruski PEN gwarantuje, że w pełni kontroluje gromadzone i przetwarzane przez siebie dane osobowe. Po upływie okresu przechowywania danych, zgodnie z powyższym, Białoruski PEN zniszczy dane opisane w Regulaminie.
Jeśli pracownik Białoruskiego PEN-u lub członek zespołu uważa, że istnieje uzasadniony powód, dla którego pewne dane nie powinny zostać usunięte po zakończeniu okresu przechowywania, musi zidentyfikować konkretne dane i poinformować kierownictwo, dlaczego dane te nie powinny zostać usunięte. Wszelkie wyjątki od Zasad przechowywania danych muszą być uzgodnione z upoważnioną osobą z Białoruskiego PEN-u.
Dostęp do danych osobowych mają wyłącznie osoby posiadające upoważnienie nadane przez administratora danych.
