We demand to put an end to the persecution of legitimate expression of views and, reaffirming our repeated calls to decriminalize defamation and to refrain from imposing custodial sentences for insulting officials, the state, government agencies, and symbols (as\u00a0mentioned\u00a0in the\u00a0<a href=\"https:\/\/spring96.org\/en\/news\/101054\" target=\"_blank\" rel=\"nofollow noindex noopener\">Joint statement of December 22, 2020<\/a>),\u00a0<strong>note the following<\/strong>:<\/p>\n<p>At the moment we know about the following persons imprisoned for having insulted Alaksandr \u0141uka\u0161enka, officials (police officers), judges and desecrated state symbols:<\/p>\n<ol>\n<li><strong>Michai\u0142 \u0141a\u017ako<\/strong>, convicted under Article 369 of the Criminal Code for insulting a representative of the authorities; he was sentenced to imprisonment in a penal colony;<\/li>\n<li><strong>Maksim D\u017eumanijaza\u016d<\/strong>, convicted under Articles 368 and 369 of the Criminal Code for insulting Alaksandr \u0141uka\u0161enka and a representative of the authorities; he was sentenced to imprisonment in a penal colony;<\/li>\n<li><strong>D\u017amitryj \u0160a\u0142ak<\/strong>, convicted under Articles 368 and 369 of the Criminal Code for insulting Alaksandr \u0141uka\u0161enka and a representative of the authorities; he was sentenced to three years and six months of imprisonment in a penal colony;<\/li>\n<li><strong>Pavie\u0142 Ku\u010darenka<\/strong>, convicted under Article 203-1 of the Criminal Code for the transfer of personal data; he was sentenced to imprisonment in a penal colony;<\/li>\n<li><strong>Andrej Hil<\/strong>, convicted under Article 369 of the Criminal Code for insulting a representative of the authorities; he was sentenced to two years of imprisonment in a penal colony;<\/li>\n<li><strong>Jarvand Marcirasian<\/strong>, convicted under Article 368 of the Criminal Code for insulting Alaksandr \u0141uka\u0161enka; he was sentenced to two years of imprisonment in a penal colony;<\/li>\n<li><strong>Siarhiej Barzaviec<\/strong>, convicted under Article 368 of the Criminal Code for insulting Alaksandr \u0141uka\u0161enka; he was sentenced to imprisonment in a penal colony;<\/li>\n<li><strong>Ja\u016dhien Stral\u010de\u0144<\/strong>, convicted under Articles 342 and 367 of the Criminal Code for participation in street protests and defamation of Alaksandr \u0141uka\u0161enka.<br \/>\n<em>There is also information about the replacement of restriction of liberty with deprivation of liberty in relation to<\/em><\/li>\n<li><strong>Siarhiej \u010carniecki<\/strong>, who was convicted under Article 391 of the Criminal Code for insulting a judge,<\/li>\n<li><strong>Stanis\u0142a\u016d Amieljaniuk<\/strong>, who was convicted under Article 370 of the Criminal Code for desecrating state symbols.<\/li>\n<\/ol>\n<p>We consider the persecution and imprisonment of the named individuals to be politically motivated, related to the peaceful exercise of expressing thoughts, and consider them\u00a0<strong>political prisoners<\/strong>\u00a0in accordance with paragraph 3.1(a) of the\u00a0<a href=\"https:\/\/spring96.org\/files\/misc\/politprisoner-guidelines-final_en.pdf\" class=\"count\" target=\"_blank\" rel=\"nofollow noindex noopener\">Guidelines on the Definition of Political Prisoners<\/a>.
