{"id":16092,"date":"2024-07-05T11:38:09","date_gmt":"2024-07-05T11:38:09","guid":{"rendered":"https:\/\/penbelarus.org\/?p=16092"},"modified":"2024-07-05T11:52:47","modified_gmt":"2024-07-05T11:52:47","slug":"zayava-pravaabaronczau-belarusi-ab-pryznanni-17-palitychnyh-znyavolenyh-2","status":"publish","type":"post","link":"https:\/\/penbelarus.org\/en\/2024\/07\/05\/zayava-pravaabaronczau-belarusi-ab-pryznanni-17-palitychnyh-znyavolenyh-2.html","title":{"rendered":"Statement of human rights defenders of Belarus on recognition of 17 new political prisoners"},"content":{"rendered":"<p style=\"text-align: center\"><em><strong>Joint statement by the Belarusian human rights community<\/strong><\/em><\/p>\n<p><em>July 5, 2024<\/em><\/p>\n<p>The Belarusian human rights community notes an increase in the number of convictions and imprisonments under several defamation and desecration of state symbols articles of the Criminal Code of the Republic of Belarus, and for other actions aimed at the lawful exercise of the freedom of expression.<\/p>\n<p>We demand to put an end to the persecution of legitimate expression of views and, reaffirming our repeated calls to decriminalize defamation and to refrain from imposing custodial sentences for insulting officials, the state, government agencies, and symbols (as\u00a0<a href=\"https:\/\/spring96.org\/en\/news\/101054\" target=\"_blank\" rel=\"nofollow noindex noopener\">mentioned<\/a>\u00a0in the Joint statement of December 22, 2020),\u00a0<strong>note the following<\/strong>:<\/p>\n<p>At the moment we know about the following persons imprisoned for having insulted Alaksandr \u0141uka\u0161enka, government officials (police officers), judges, desecrated state ans state symbols, and exercised their freedom of opinion in other forms, including the conviction and punishment of:<\/p>\n<ul>\n<li><strong>Dzmitry Puzika\u016d<\/strong> under Article 370 of the Criminal Code for tearing down the red-green flag; he was sentenced to 6 months of imprisonment in a penal colony;<\/li>\n<li><strong>Dzianis Siemianichin<\/strong> under Article 368 of the Criminal Code for insulting A. \u0141uka\u0161enka; he was sentenced to one year in a penal colony;<\/li>\n<li><strong>Dar\u2019ja Zajac<\/strong> under Article 370 of the Criminal Code for burning a red-green flag; she was sentenced to one year of imprisonment in a penal colony;<\/li>\n<li><strong>Valeryja Drahun<\/strong> under Article 370 of the Criminal Code for burning a red-green flag; she was sentenced to one year of imprisonment in a penal colony;<\/li>\n<li><strong>Alena Karpienka<\/strong> under Article 367 of the Criminal Code for defamation of A. \u0141uka\u0161enka; she was sentenced to one year and six month of imprisonment in a penal colony;<\/li>\n<li><strong>Andrej Karalo\u016d<\/strong> under Article 368 of the Criminal Code for insulting A. \u0141uka\u0161enka; he was sentenced to two years in a penal colony;<\/li>\n<li><strong>Anton Puha\u010d<\/strong> under Articles 368 and 369 of the Criminal Code for insulting A. \u0141uka\u0161enka and an official; he was sentenced to one year and six month of imprisonment in a penal colony;<\/li>\n<li><strong>Alena Dubro\u016dskaja<\/strong> under Article 368 of the Criminal Code for insulting A. \u0141uka\u0161enka; she was sentenced to one year and six month of imprisonment in a penal colony;<\/li>\n<li><strong>Ivan Dziarnovi\u010d<\/strong> under Articles 367, 368, 369 of the Criminal Code for defamation of A. \u0141uka\u0161enka, an insult of A. \u0141uka\u0161enka and an official; he was sentenced to four years of imprisonment in a penal colony;<\/li>\n<li><strong>Alaksandr Zachar\u010dyk<\/strong> under Article 367 of the Criminal Code for defamation of A. \u0141uka\u0161enka; he was sentenced to 3 years of restriction of freedom in an open-type correctional institution and sent to serve his sentence;<\/li>\n<li><strong>Jury Jur\u010duk<\/strong> under Article 368 of the Criminal Code for insulting A. \u0141uka\u0161enka; he was sentenced to restriction of freedom in an open-type correctional institution and sent to serve his sentence;<\/li>\n<li><strong>Tacciana Makiejeva<\/strong> was placed in custody under Part 1 of Articles 342, 368, 369, 391 of the Criminal Code on charges of organizing mass events, insulting A. \u0141uka\u0161enka, an official, and a judge;<\/li>\n<\/ul>\n<p>Human rights activists are also aware of a number of people who were sent to a psychiatric hospital for compulsory treatment under defamation articles: <strong>Rus\u0142an Zholi\u010d<\/strong> under Articles 369, 368 of the Criminal Code, <strong>Dzmitry Si\u016dko<\/strong> under Article 369 of the Criminal Code, <strong>Alaksandr Ciupa, Ivan Mik\u0161a<\/strong> under Article 370 of the Criminal Code, <strong>Alaksandr Syryca<\/strong>\u00a0under Article 369 of the Criminal Code.<\/p>\n<p>We consider the persecution and imprisonment of the named individuals to be politically motivated, related to the peaceful exercise of expressing thoughts, and consider them\u00a0<strong>political prisoners<\/strong>\u00a0in accordance with paragraph 3.1(a) of the\u00a0<a href=\"https:\/\/spring96.org\/files\/misc\/politprisoner-guidelines-final_en.pdf\" class=\"count\" target=\"_blank\" rel=\"nofollow noindex noopener\">Guidelines on the Definition of Political Prisoners<\/a>.
